General Terms & Conditions Movement Amsterdam

Definitions

  • Member: the natural person who enters into an agreement with Movement Amsterdam.

  • Movement Amsterdam: the party to these terms and conditions, located at Derde Schinkelstraat 1A-3, 1075 TJ Amsterdam.

  • Sports Studio: the sports facility of Movement Amsterdam.

  • Trainer: the natural person providing the training on behalf of Movement Amsterdam.

  • Training: the personal training session, group class, or workshop provided by Movement Amsterdam.

  • Website: the website www.movementamsterdam.nl, managed by Movement Amsterdam.

Article 1 – General & Applicability

1.1 Scope of Application

These terms and conditions apply to all agreements between the Member and Movement Amsterdam for the provision of training services.

1.2 Invalidity of Provisions

If any provision of these terms and conditions is found to be invalid or voidable, the remaining provisions remain fully in force. The parties shall consult to agree on replacement provisions that preserve the intent of the original provisions.

1.3 Interpretation

In case of ambiguity, the 'spirit' of the provision shall prevail.

1.4 Unregulated Situations

Situations not covered by these terms and conditions shall be assessed in accordance with their 'spirit'.

1.5 Non-Strict Compliance

Failure to strictly enforce any provision does not waive the right to enforce it in other instances.

1.6 Affiliated Persons

Partners and trainers of Movement Amsterdam may also invoke these terms and conditions.

Article 2 – The Offer

2.1 Revocability

The offer is non-binding and may be revoked by Movement Amsterdam.

2.2 Packages and Rates

Movement Amsterdam offers packages, memberships, and individual rates; all prices include VAT.

2.3 Duty to Inform Member

The Member must provide full and honest information for the price quotation and order confirmation.

2.4 Errors and Omissions

Movement Amsterdam is not bound by unintentional errors on the website, publications, or emails.

2.5 Temporary Suspension

Movement Amsterdam may temporarily suspend new admissions.

Article 3 – Registration/Enrollment

3.1 Formation of Agreement

An agreement is formed upon registration and acceptance of these terms and conditions via the online form or in person by signing the agreement form.

3.1.1 Electronic Confirmation

Checking the acknowledgment box on the Website constitutes an electronic signature in accordance with the Electronic Signatures Act.

3.2 Confirmation

Upon registration, the Member receives a confirmation email; if not received, the Member must contact Movement Amsterdam.

3.3 Rates and Duration

By registering, the Member agrees to the applicable rate and the specified duration.

3.4 Admission Restrictions

Movement Amsterdam may refuse registrations, such as for health reasons.

3.5 Use of Image Material

The Member consents to photographs taken during training being used on social media.

Article 4 – Right of Withdrawal

4.1 Withdrawal Period

The Member has a 14-day withdrawal period starting the day after the agreement is concluded.

4.2 Exercise

To exercise the right of withdrawal, the Member must send an email to info@movementamsterdam.com within 14 days.

Article 5 – Term & Termination

5.1 Term and Renewal

Memberships are tacitly renewed for one month if not terminated in time.

5.2 Notice Period

Termination must occur no later than one calendar month before the end of the agreed term.

5.3 Suspension

Suspension is possible for illness, injury, or pregnancy, upon proof (e.g., doctor's certificate), for the duration specified in these terms.

5.4 Location Change

If the Sports Studio relocates, the agreement automatically transfers to the new location under the same conditions.

Article 6 – Payment

6.1 Primary Payment Method

Payment is primarily made by direct debit. The Member authorizes this and ensures sufficient funds.

6.2 Default and Interest

In case of late payment, the Member is in default without notice and owes statutory interest of 11%.

6.3 Suspension of Participation

If in default for more than two weeks, the Member may not participate until full payment and one month's advance payment are made.

6.4 Refunds

Purchased memberships or class packages are final and non-refundable.


6.5 Warning and Reasonable Payment Period

Movement Amsterdam sends a written reminder and allows a reasonable period of at least 14 days after the invoice date to make payment.

6.6 Failed Direct Debit

In case of a failed direct debit, Movement Amsterdam is entitled to charge an additional fee of €10.

Article 7 – Rates

7.1 Rate Changes

Movement Amsterdam may change its rates.

7.2 Notification

The Member will be notified by email at least 30 days before the new rates take effect and may terminate without cost if rates change.

Article 8 – Registration & Deregistration for Training

8.1 Personal Training

Cancellation less than 24 hours before or no-show results in 100% of the cost being charged.

8.2 Group Classes & Workshops

Registration and deregistration via the Website or app must be done at least 12 hours before the class. 

8.3 Cancellation by Movement Amsterdam

Movement Amsterdam may cancel classes due to insufficient enrollment or force majeure and will notify as soon as possible.

Article 9 – Force Majeure

9.1 Definition of Force Majeure

In case of unforeseen and uncontrollable circumstances, Movement Amsterdam may suspend its obligations.

9.2 Suspension and Termination

After three months of force majeure, either party may terminate the agreement without liability for damages.

9.3 Partial Performance

Performed services at the time of force majeure will be invoiced separately and are immediately payable.

Article 10 – Liability

10.1 Own Risk

Participation is entirely at the Member's own risk.

10.2 Exclusion of Liability

Movement Amsterdam and its employees are not liable for damage or injury unless due to intent or gross negligence.

10.3 Loss of Property

No liability for loss or theft of personal property.
